recentyears,accordingtosomeresports,ononehand,thenumbersofteacherscriminalsareincreasingwiththeyearspassingby.Ontheotherhand,inthemodernworld,thecompetitionforcomprehensivenationalstrengthfocusonthecompetitionofhumanresources.
whileamongthelotsofproblemsinrecentChina,itisanundisputablefactthatthequalityofhunmanresourcesmustbespeedilyimproved.Althoughfromthepointofgreatopinionsoneducation,thekeylinkofthesolutionliesinnotonlytheeducation.Inordertocultivatethefollow-upof"thehigh-caliberpersonnnel",thatis,tocultivatethesuccessorsofsocialistcause,theteachers'qualityisofthegreatestimportance.
OnaviewofconstrucationofChinesepoliticsandlawsystem,teachersshouldatleastpossessthefollowingseverallegalsenses.
Firstly,thesenseofmakingclearthatacquisitionofteachers'qualificationandnailingdowntheirownlegalstanding.
Afterthereformandopening-up,ourknowledgeofteachers'legalstatushavegonethroughtheprocessfromobscuritytodefinitnes;EspeciallyonOctober31stof1993,thelawofTeacherwentforth.Itisatthefirsttimethat"Teacher'sQualificationiscarriedoutinChina"isclearlydelineatedinlegalform.Therefore,thewholesociety'sknowledgeaboutteachers'rightfulposition.whilequalificationofteacherisnotthesufficientconditionbutthenecessaryconditionforacitizentodoteachingjobs.
Inanotherword,thosepeoplewhopossessqualificationofteacherscanbecomerealteachersonlyundertheconditionthattheyareemployedbysomeschools.Andtheschoolswillselecttheexcellentemployeesfromthosepossessingqualificationofteachersaccordingtotherequirementpositions.
Secondly,thesenseofconscientiouslystudying,carryingout,understandingandinstructingthesocialismmodernruleoflaw.
Ourteachers'jobslieinthefrontlineof"cultivatingsocialismcausesuccessors".Accordingly,inordertomakestudentsunderstandthebasiccomponentsof"socialismmodernruleoflaw"and"constructingsocialismpoliticalcivilization"teachersoughttofIrststudyconscientiouslytounderstandthemeaningof"managingstateaffairsaccordingtolaw"secondnaildownthebasicrequirementandcharactersofconstructingsocialismruleoflawstateintheConstitution's(adoptedin1982)generalrequirementforconstructionofourcountry'ssocialismruleoflawinthesystemandthemembers'behaviorinthewholesociety.Consequentlyonthebaseoffurtherlycarryingthroughandputtingintoeffectteachers'professionalethics,throughtherighfulunderstandingofsocialismmodernruleoflaw,sothekeyof"runningstateaffairsaccordingtolaw"isgoverningorrestrictingstate'sright;Thesubstanceof"runningstateaffairsaccordingtolaw"ismanagingrightsaccordingtolaw.Itshouldbenaileddownthatthegovernmentandherofficialsareatfirstthetargetsorobjectsofsocialruleoflaw,andthenthesubjectofthesecondconductitsactivitieswithintheframeworkoftheConstitutionandthelaw.Citizens(includingteachersandstudents)aswellasotherorganizations(includingschools)shouldalsoobeytheConstitutionandthelaw.Thirdly,establishingthenotionoftreatingstudentsandtheirparentsequally,thatis"Allmenareequalinthesightoflaw".
Everyteachershouldmakeclearthat,thelegalrelationshipbetweenteachersandstudents'parentsiscivillegalrelationship;theeducationalactivitiesthatteachersconductduringtheirdailyjobsisnotadminstrativeactivitiesbutakindofspecialcivilobligation.Consequentlyteachersshouldnotsetthemselvesupasgoverner,butlearntotreatstudentsandtheirparentsequally,andestablishthenotionof"Allmenareequalinthesightoflaw".Whichisexhibitedinthefollowingaspects:respectingoneself,respectingotherpeople,respectingsociety,respectingnatureandrespectingknowledge.
Inshort,nootherthanteachersatfirstpossessthelegalconsciousnesswhichcorrespondstoteachers'qualificationandtheteachersmustactinstrictaccordancewiththelaw,thenlearntorespectothersequally,thuscompetence-orientededucationtostudentscanbeconductedinanall-roundway.Thepreventionofcriminalcasesconcerningjuvenilescanreduceaflaw.Onlycultivatingthehigh-caliberpersonnelthatmeettheneedofsocialdevelopmentandtheirowndevelopment,canmatchtheconditionofsocialismruleoflawcondition.
Inthisway,theconditionforrealizationofquality-orienrededucationintoinstitutionalizationandlaw-basedcanbemorewell-appointed.（作者单位：江西理工大学）
